The Local Government Ombudsman has recently highlighted that councils cannot put a cap on personal budgets.
The Ombudsman highlighted that Wiltshire County Council had acted illegally by capping people’s personal budgets by operating a banding system, which is contrary to the guidance on the Care Act 2014, which states that personal budgets should be based on individual need.
